Surprise destination

On Vacation offers you the product where you can purchase your vacations to incredible destinations at an amazing price:

  • The Surprise destination applies to San Andres, Riohacha, Santa Marta, Amazonas in On Vacation's own hotels and can be chosen or modified at no cost by the client at the time of reconfirmation or when selecting the surprise destination of the reservation according to air and hotel availability.
  • The dates of travel that can be redeemed will be from May 1, 2024 to December 10, 2025 (Except Easter Week April 11 to 18, 2025 - Week break Oct 4 to 14 2024 and 3 to 13 October 2025, 20 December 2024 to 10 January 2025), dates that will be published on the website through the link https://www.onvacation.comm/terminos-y-condiciones according to air and hotel availability available for passenger selection.
  • The surprise destination that has not set a reservation by December 10, 2025, the reservation becomes cancelled and will be subject to the cancellation penalties and/or reactivation charges stipulated in the contract for the provision of tourism services.

- The surprise destination includes: air tickets, nights of lodging according to the current travel cycle, meals according to the confirmed hotel, beverages in the hotels that apply (subject to restaurant and/or bar schedules). It does not include: Tourist entrance card according to the selected destination, payment to be made by the passenger at the airport. Transportation airport - hotel - airport. Food, beverages and transportation not related. Entrance to tourist sites. Receptive services not related.

  • The redemption of the reservation can be made up to 5 days prior to the travel date and/or at least 30 days prior to the travel date. Subject to air and hotel availability.
  • The reservation will be created by default with destination San Andres and travel date June 30, 2025. The date and destination mentioned that will be registered in the contract is for information purposes for booking and payment of the trip and does not correspond to the date of travel, which will be selected by the client according to air and hotel availability.
  • Additional passengers not included in the initial reservation must pay the current rate.
  • The client may make partial or fractional use of the passengers purchased in the contract of its Surprise Destination within the term of validity for fixing the reservation.

Hosting and Full Plan Terms and Conditions

For all purchases of accommodation in hotels operated by ON VACATION or subscribed to its agreements, the enclosed TOURIST SERVICES PURCHASE AND SALE AGREEMENT will be sent to the registered e-mail address:

 

CLAUSE ONE. PARTIES: On the one hand, TOUR VACATION HOTELES AZUL S.A.S., with NIT 900.304.940-9 hereinafter THE SELLER and on the other hand, THE PURCHASER, who is duly identified in the reservation data.

 

FIRST PARAGRAPH: TOUR VACATION HOTELES AZUL S.A.S. is a travel and tourism agency engaged in the marketing and sale of tourism products and services, among others, as stated in the Certificate of Existence and Legal Representation, with National Tourism Registry 26847.

 

CLAUSE TWO. OBJECT: THE PURCHASER hereby agrees with THE SELLER to purchase a tourist package in exchange for a price and in accordance with the specifications detailed below:

 

FIRST PARAGRAPH: The price of the contract includes charges, supplements and taxes (airport taxes, fuel charges, legal withholdings, insurance charges, legal taxes). NOT INCLUDED: 1. Tourist cards. 2. Entry cards to the selected destination. 3. Other taxes established by the competent authorities. 4. Concepts not specified in the purchased plan. The hold luggage service is not included in the tourist plan for any type of flight and may be purchased additionally according to the current rates, the amount of luggage allowed per person is one (1), the weight and volume of each bag will be reviewed prior to the flight in accordance with the policies of each airline, remember to check the baggage policies with the airline. In case the baggage exceeds the weight authorized by each airline, the PURCHASER agrees to assume the additional costs. In case of baggage loss or delay, the airline will be responsible under the terms of the Civil Aeronautical Regulation No. 3 Civil Air Activities.

 

SECOND PARAGRAPH: INFANT AND CHILD: Infant means any person who has not reached 2 years of age at the date of return of the trip; child means any person older than 2 years of age and who has not reached 12 years of age at the date of return of the trip; senior passenger means any person older than 12 years of age who has not reached 65 years of age at the date of return of the trip; senior passenger means any person older than 65 years of age. The entry of infants and children to hotels and flights is restricted if they do not have the presence of a legal guardian, parent, guardian or letter of permission of the same (subject to conditions of Migration Colombia and each of the airlines).

 

THIRD PARAGRAPH.- TRIP CANCELLATION GUARANTEE: Its purpose is to guarantee the use of tourist services for customers in the following cases: A) Death of any of the passengers listed in the reservation, in this case 100% of the paid value of the passengers in the reservation will be available, discounting the value of the guarantee in services if so defined by the BUYER B) Illegal deprivation of liberty of any of the passengers listed in the reservation, 100% of the paid value of the passengers in the reservation will be available, discounting the value of the guarantee. C) Illness certified by a health center authorized by the Ministry of Health or the National Superintendence of Health of any of the travelers appearing in the reservation and that due to their condition expressly indicates the impossibility of using the services, guarantees the reprogramming of the trip without penalty only for the affected traveler. D) Obstruction of the access roads to the place or terminal of departure certified by competent authorities, guarantees the reprogramming of the trip without penalty. E) In case of death of a family member of a passenger of the reservation or illness certified by EPS of a family member of the first degree of consanguinity or spouse, guarantees the rescheduling of the trip without penalty.

 

CONDITIONS: The cancellation guarantee applies to passengers who acquire it to enjoy the company's tourist program, its coverage begins once the purchase of the tourist service has been made and the travel documents issued, it expires at the end of the use of the tourist services contracted; the term to execute the guarantee is eight (8) calendar days counted from the occurrence of any of the events described; to reactivate the reservation and access the services, the client must pay the readjustment to the rate and deduction of cancellation guarantee.

 

CLAUSE THREE. PRICE: THE BUYER agrees to pay unconditionally to the order of THE SELLER the amount according to the defined service), MONEY THAT WILL BE EXCLUSIVELY RECEIVED IN THE ELECTRONIC AND PRESENT MEANS DESCRIBED BELOW: 1. ONLINE PAYMENTS http://pagosonline.onvacation.com/ THROUGH OUR WEB PAGE, ENTER WITH THE RESERVATION NUMBER OR ID NUMBER OF THE HOLDER AND YOU WILL BE ABLE TO MAKE THE PAYMENT ONLINE; 2. DAVIVIENDA BANK CONSIGNMENT: SAVINGS ACCOUNT 485100000994; AGREEMENT 1160092 IN THE NAME OF: FINANTODO PAYMENT REFERENCE: HOLDER'S IDENTIFICATION CARD NUMBER; 3. BANCOLOMBIA BANK CONSIGNMENT: CURRENT ACCOUNT: 30471143381 AGREEMENT: 40288 IN THE NAME OF: FINANTODO PAYMENT REFERENCE: HOLDER'S IDENTIFICATION CARD NUMBER; 4. PARAGRAPH ONE: PAYMENT INFORMATION: In order to avoid inconveniences with payments, THE BUYER is informed that THE SELLER shall not be liable for payments made in a manner different from what is indicated in clause three and especially for monies delivered in cash to the sales consultant, TOUR VACATION HOTELES AZUL S.A.S., shall not be liable for monies that have not been entered into its accounting records. Any claim derived from payments must be processed before the Customer Service Department of THE VENDOR, in Bogota at telephone (1) 3848560, national toll free line 01 8000 121049, at number # 336 from Tigo, Claro, Movistar and/or filed request through the module file a PQRSF in the link https://servicioalcliente.onvacation.com/.

 

FOURTH CLAUSE.- METHOD OF PAYMENT FOR TRIPS DATED FOR MORE THAN 31 DAYS (SCHEDULED SALE): If the trip takes place between (31) calendar days or more, counted from the perfection of this contract, THE PURCHASER must pay a minimum of 10% of the final value of the plan to reserve. The balance shall be paid in the number of equal monthly installments according to the account statement and until 100% of the final value of the plan is completed, with a maximum term of 30 calendar days before the travel date.

 

FIFTH CLAUSE.- METHOD OF PAYMENT FOR TRIPS WITH A DATE LESS THAN 30 DAYS (SALE PER DAY): If the trip will take place within the (30) calendar days following the execution of this contract, THE PURCHASER shall pay a minimum of 40% of the final value of the plan to reserve. The balance shall be paid twenty (20) calendar days prior to the date of travel. If the trip will take place within twenty (20) calendar days following the receipt of this contract in the PURCHASER'S email, the PURCHASER must pay 100% of the final value immediately.

 

CLAUSE SIX. PERFECTION: The contract entered into between the parties is perfected from the moment the first payment is made by the BUYER by any of the official collection means of the SELLER and at the moment the reservation is confirmed by the SELLER, and the main benefits payable by the SELLER shall become effective when the total payment of the agreed contract is made and on the contractually determined dates.

 

PARAGRAPH RIGHT OF WITHDRAWAL: THE PURCHASER has the right of withdrawal which may be exercised within five (5) business days following the execution of this contract, which will resolve the same and must be reinstated as paid in the terms of law, the request for withdrawal must be filed through the module file a PQRSF in the link https://servicioalcliente.onvacation.com/

 

PARAGRAPH REVERSAL OF PAYMENT. - THE BUYER in case of identifying that the operation carried out is fraudulent or not requested or that the service requested does not correspond to what was required, shall file a complaint with the SELLER within five (5) business days following the date when THE BUYER had notice of the fraudulent or unsolicited operation and notify the issuing bank of the claim, for the purpose of coordinating the reversal of payment under the terms of Law 1480 of 2011 and Decree 587 of 2016.

 

SEVENTH CLAUSE. CHANGES AND NOVELTIES: THE PURCHASER may request changes in the reservation of the tour package, development of the product and / or service purchased and other conditions, through the link https://bit.ly/3gAprq0 taking into account that the conditions of the table of changes and novelties will be applicable with the readjustment of the rate for changes or other additions that at the time will be settled to the BUYER and will be of immediate and total payment, or request the surplus in services provided by the company; or in money if the variation or change in the service is attributable to the VENDOR except for the modifications and changes determined by the service providers, in accordance with the liability clause and the terms and conditions established by them, in order to ensure the success of the trip. The value to be assumed by THE PURCHASER for the changes and novelties required is determined below:

3Forchange of date and change of destination less than or equal to 30 days, the resulting value once discounted the value to be assumed by the PURCHASER for the change and novelty required, will be reimbursed within the deadlines established by law, in the events that the air transport is commercial will correspond to promotional rate, Therefore, the applicable charges shall be those determined by the airline authorized by the Civil Aeronautics and charged to the holder of the reservation. The PURCHASER is also informed from this moment on, that the promotional rate air tickets are not refundable in case of cancellation, according to paragraph 3.10.1.8.1. Of the Aeronautical Regulations of Colombia (RAC 3).

By provision of Article 68 of Law 336 of 1996, air transportation is an essential public service governed by the regulations of the Aeronautics, therefore the charges for no-show of the BUYER in tourism matters cannot be applied.

The charges for changes and new features of the previous table described in this contract, will be applicable for each person of the reservation, which from the perfection of the contract the BUYER declares are known, informed, explained and accepted.

4Incases where the PURCHASER wishes to make a change of destination or date, the current rate will be applied provided that it is not lower than the initial rate purchased, in which case the initial purchase rate will be applied.

 

PARAGRAPH ONE: RE-ACTIVATIONS: In the event that the reservation has been cancelled due to non-compliance by THE PURCHASER, he/she may re-activate it and the parties shall determine a new travel date, with the re-settlement of rates according to the travel season and subject to availability, or terminate the contract, for both cases the additional applicable values to be assumed by THE PURCHASER, the rate adjustment and the discount of the guarantees for each re-activation and in the case of cancellation the penalties set forth in Clause Eight of this contract must be taken into account.

 

CLAUSE EIGHTH: PENALTIES: The penalties of the present contract, will be applicable for each person of the reservation and are those described below, which are known, informed, explained and accepted by THE PURCHASER, in cases of trip cancellation, 100% of the Travel Guarantee per passenger will be deducted. Any cancellation in the reservation of the tourist package, development of the product and/or service purchased and other conditions, may be made by THE PURCHASER through the link https://bit.ly/3gAprq0 taking into account that the conditions of the following table will be applicable:

2Forthe case of cancellations less than or equal to 30 days, the resulting value after deducting the corresponding penalty, will be reimbursed within the terms established by law, in the events that the air transportation is commercial will correspond to promotional rate, therefore the applicable penalties will be those that the airline authorized by the Civil Aeronautics determines and charged to the holder of the reservation, also informs the BUYER from this moment, that the promotional rate air tickets are not refundable in case of cancellation, according to paragraph 3.10.1.8.1. From the Colombian Aeronautical Regulations (RAC 3).

According to Article 68 of Law 336 of 1996, air transportation is an essential public service governed by the Aeronautical Regulations, therefore, no tourist service penalties may be applied.

 

THE SELLER shall proceed to cancel the respective reservations in the following cases: 1) If within the 24 hours following the fixing of the reservation, the corresponding payment to maintain it has not been made. 2) When the PURCHASER does not make the monthly and proportional payments on the dates and for the amount established in the account statement. 3) In case this contract is not paid in full at least thirty (30) calendar days before the travel date or twenty (20) calendar days before the travel date depending on whether it is a scheduled sale or a day sale.

 

CLAUSE NINE. TERMINATION: THE SELLER may terminate this contract with just cause when THE BUYER does not comply with the timely partial or total payment of this contract. In case of termination of the contract by either party, the SELLER shall proceed to liquidate and require the payment of the proportional values corresponding to the no show at the hotel, cost of having reserved seats on flights and the expenses incurred by the SELLER for the reservation with its suppliers, THE PARTIES recognize the executive merit of this contract.

 

TENTH CLAUSE. VERIFICATION OF TERMS: The VERIFICATION OF TERMS AND CONDITIONS explained to THE PURCHASER is an integral part of this contract, who accepts that there are no additional verbal promises or conditions, since this contract and the attached document contemplate all the stipulations, conditions and services that he/she accepts and acquires.

 

CLÁUSULA DÉCIMA PRIMERA. CLÁUSULA DE RESPONSABILIDAD Y OBLIGACIONES: TOUR VACATION HOTELES AZUL S.A.S., sus operadores y agentes se responsabilizan ante EL COMPRADOR por la prestación completa y por la calidad de los servicios turísticos descritos ofrecidos directamente, en los términos del Decreto 2438 de 2010, Ley 300 de 1996, Ley 1480 de 2011 y demás leyes y normas que las complementen y adicionan. De acuerdo con la Ley turística y en especial al Decreto 2438 del 9 de julio de 2010, se determina que: 1. EL VENDEDOR, sus operadores y agentes, no se hacen responsables por las cancelaciones, demoras, daños, eventos o inconvenientes que se causen o presenten por o con ocasión de eventos como fuerza mayor o caso fortuito, tales como huracán, maremoto, terremoto, accidentes, fenómenos climáticos o naturales, condiciones de seguridad, factores políticos, huelgas, paros, guerras, asonadas, negación de permisos de ingreso, asuntos de salubridad y cualquier otro evento, tales como sobreventa, desvíos, sobreocupación y cualquier otro evento atribuible a un factor externo de Comercio que pueda ser catalogado dentro de los mismos que pudieren ocurrir durante el viaje o antes de este. Que no podrán ser previsibles e irresistibles por parte de EL VENDEROR, pese a actuar con la debida diligencia y previsión de cada caso. 2. Por las razones mencionadas anteriormente y con el fin de garantizar el éxito del viaje EL VENDEDOR tiene la facultad de efectuar las modificaciones a los servicios turísticos ofrecidos y contratados. 3. EL VENDEDOR, sus operadores y agentes no se hacen responsables por los accidentes que EL COMPRADOR sufra en el lugar u hotel de destino, pues tal responsabilidad concierne únicamente a ELCOMPRADOR o al HOTEL en el caso concreto o del seguro hotelero contratado por EL COMPRADOR para tal fin. 4. En caso de daño, irregularidades o alteraciones de las aeronaves, situaciones adversas de las aerolíneas contratadas, condiciones climáticas adversas, circunstancias anormales en los puertos de embarque y desembarque de pasajeros; cambio de itinerario, retrasos, dilaciones, aplazamientos y cualquier otro incidente fuera del ámbito de control de EL VENDEDOR en que los vuelos sean retrasados en su lugar de origen o en cualquier otra ubicación, sin que exista en ningún caso algún tipo de responsabilidad de EL VENDEDOR, será la aerolínea la responsable de todas las cancelaciones, aplazamientos, retrasos o anomalías de los vuelos e itinerario que le sean imputables, por lo que EL VENDEDOR no es responsable de éstas. La aerolínea se reserva las facultades conforme al contrato de transporte aéreo y en particular las contenidas en el Reglamento Aeronáutico Colombiano. 5. Se entiende que cuando EL COMPRADOR adquiere el paquete turístico de los enunciados en este documento, conoce y comprende las distintas categorías de hoteles ofrecidos y que se le han hecho saber todas las características, servicios incluidos y no incluidos del hotel elegido o seleccionado por éste y las acepta, incluidos los horarios de alimentación, entrada y salida. 6. EL VENDEDOR, sus agentes y operadores no se hacen responsables frente a los asuntos legales u otros inconvenientes en que pueda verse involucrado EL COMPRADOR, tampoco frente a los gastos personales cuando EL COMPRADOR se vea obligado a retirarse del viaje o la prestación de los servicios turísticos por tales motivos, teniendo en cuenta que dichos gastos deberán ser asumidos únicamente por EL COMPRADOR.7. EL VENDEDOR, sus agentes y operadores no se hacen responsables de la pérdida, sustracción, deterioro o daño del equipaje y demás objetos que EL COMPRADOR lleve consigo. EL COMPRADOR deberá antes del viaje, consultar las políticas de equipaje de las aerolíneas que prestarán el servicio aéreo, informándose sobre las dimensiones, peso y elementos que puede o no transportar en el equipaje, tales como Equipaje libre permitido, Equipaje de mano, transporte de mascotas, Exceso de equipaje, Equipaje especial, Mercancías prohibidas y peligrosas, y demás recomendaciones generales importantes para usar el transporte aéreo. 8. EL VENDEDOR sus agentes y operadores tendrán la facultad de retirar del viaje a quien incurra en cualquier violación al Código Nacional de Policía o incumpla las obligaciones de su carácter de huésped emanadas del contrato de hospedaje, caso en el cual El COMPRADOR tendrá derecho al reintegro del valor de los servicios turísticos no disfrutados. 9. EL COMPRADOR deberá pagar los daños que ocasione a la infraestructura del hotel, a los bienes en el incorporados o a los demás huéspedes, y EL VENDEDOR podrá cobrarle mediante vía ejecutiva, las facturas que acrediten los gastos derivados de dichas acciones declarando que prestan pleno mérito ejecutivo. 10. Acepta EL COMPRADOR desde este momento y se compromete a pagar incondicionalmente el total de la factura que emita EL VENDEDOR, por concepto de servicios de alojamiento y alimentación que le suministren por cualquier circunstancia de fuerza mayor, incluida la obligación de guardar estricta cuarentena en el Hotel por ser positivo para COVID-19 si sobre pasa su periodo de alojamiento inicialmente contratado, igualmente EL COMPRADOR asumirá el costo, penalidades y demás valores que se generen por los cambios de fecha de los tiquetes aéreos debido a las circunstancias de fuerza mayor y/o enfermedad por Covid-19 que le sobrevengan durante su permanencia en el establecimiento hotelero. 11. EL VENDEDOR sus agentes y operadores podrán dar información a EL COMPRADOR, previa solicitud por escrito, para la obtención de la documentación requerida para su desplazamiento en los destinos nacionales e internacionales, siendo obligación de EL COMPRADOR el cumplimiento de los requisitos respectivos. EL VENDEDOR sus agentes y operadores no asumen responsabilidad alguna en caso que las autoridades del destino, país o países visitados, nieguen a EL COMPRADOR los documentos requeridos para el ingreso o no se lo permitan, evento en el cual EL COMPRADOR tendrá derecho al reintegro del valor de los servicios turísticos no disfrutados, con exclusión de las penalidades que cobre EL VENDEDOR y los proveedores conforme a sus propias reglamentaciones y de la silla aérea utilizada para el transporte, si fuere el caso. 12. EL VENDEDOR podrá hacer los ajustes o cambios necesarios en la reserva, si el país al que se dirigen presenta problemas sociales, económicos, políticos o de orden público que generen riesgos a la seguridad e integridad física del COMPRADOR y/o sus acompañantes.

Obligaciones de EL VENDEDOR; se compromete a prestar un servicio turístico con la calidad exigida por el Estatuto del Consumidor en los términos del Decreto 2438 de 2010, Ley 300 de 1996, Ley 1480 de 2011 y demás leyes y normas que las complementen y adicionan. EL VENDEDOR se compromete a suministrar información de los productos y servicios para el alojamiento, las tarifas y la disponibilidad de los hoteles, Atender en forma adecuada, oportuna y respetuosa a todos los requerimientos del EL COMPRADOR sin excepción ni discriminación alguna por sexo, raza, edad, enfermedad o credo. EL VENDEDOR dispondrá y utilizará todos los recursos físicos, elementos tecnológicos, didácticos y asistenciales con que cuenta la compañía, procurando la óptima calidad en la prestación del servicio. El VENDEDOR garantiza que los permisos o licencias requeridas se encuentran vigentes, y en caso de incumplir con sus obligaciones el cliente podrá solicitar la devolución proporcional del servicio no prestado, reprogramar su fecha de viaje en caso de ser una cancelación atribuible a EL VENDEDOR o de no ser posible concertar una nueva fecha de viaje; en ese evento se procederá a la devolución del dinero en los términos del Decreto 2438 del 2010.

 

CLAUSE TWELFTH. OBLIGATIONS OF THE PARTIES: In addition to the obligations contemplated in the legislation applicable to the contract in tourism and commercial matters, THE BUYER declares that it was adequately informed of the scope of the liability clause that THE SELLER has as a tourist service provider according to the Tourism Law, and THE BUYER declares that it has received a copy of the Liability Clause included in this contract.

 

CLAUSE THIRTEENTH. GENERAL CONDITIONS. 1. THE PURCHASER was adequately informed of the conditions of responsibility and handling granted by the Law of Tourism. THE PURCHASER was informed of the sanitary and epidemic control measures that must be complied with in order to travel to its destination, and was also informed of the travel assistance services. 2. The term of the legal guarantee of the tourist services of this contract shall be forty-five (45) calendar days after the execution of this contract counted from the day following the end of the trip, time in which the BUYER in accordance with No. 3 of Article 58 of Law 1480 of 2011 must make its direct claim. THE SELLER rejects any form of exploitation, pornography, violence and sexual tourism; THE SELLER is committed to the protection and prevention against any form of sexual exploitation, pornography and sexual tourism with children and adolescents in accordance with Law 1336 of 2001 and Law 679 of 2001, and other regulations that complement or add to it. Additionally, it warns THE PURCHASER that sexual exploitation and sexual abuse of children and adolescents in Colombia are punishable by criminal and administrative sanctions, according to the laws in force.

 

CLAUSE FOURTEENTH: HABEAS DATA: THE PURCHASER authorizes TOUR VACATION HOTELES AZUL, under the terms of the Statutory Law 1581 of 2012 and its regulatory decrees, to collect, record, store, manage, use, transmit, update and delete your data in order to perform administrative management, billing management, management of collections and payments, economic and accounting management, management of internal statistics, opinion surveys, data update campaigns and information on changes in the processing of personal data, analysis for the control and prevention of fraud and money laundering, including but not limited to the consultation of reports in restrictive lists, entity of central information or database in order to prevent any type of activity related to ML / FT, attention to information queries, marketing, commercial prospecting and transmission of data within the framework of this contractual relationship to its allied companies.

It is optional to provide information concerning data of minors or sensitive data, understood as those that may affect privacy or generate any type of discrimination.

According to Article 8 of the Statutory Law 1581 of 2012, the rights of the BUYER with respect to personal data that are provided are the following: a) Know, update and rectify their personal data to TOUR VACATION HOTELES AZUL. b) Request proof of the authorization granted to TOUR VACATION HOTELES AZUL. For the collection and use of personal data except when such authorization is not necessary under the terms of the Statutory Law 1581 of 2012. c) Be informed by TOUR VACATION HOTELES AZUL. Upon request made by THE PURCHASER, regarding the use that has been made of their personal data. d) File a complaint with the Superintendence of Industry and Commerce for violations of the Statutory Law 1581 of 2012 and other rules that modify, add or supplement it. e) Revoke the authorization and/or request the deletion of personal data when its collection and/or use does not respect the principles, rights and constitutional and legal guarantees. The revocation and/or deletion of the data will proceed when the Superintendence of Industry and Commerce has determined that in such collection TOUR VACATION HOTELES AZUL. has incurred in conduct contrary to the Statutory Law 1581 of 2012. f) Access free of charge to their personal data that have been subject to collection and/or use. THE PURCHASER authorizes the application of the privacy and confidentiality policies of personal data established in http://www.onvacation.comm and therefore with the subscription of this contract THE PURCHASER indicates that: I grant my free, voluntary, informed and express authorization to carry out the processing of my data. CLAUSE FIFTEENTH: DECLARATION OF THE PARTIES: THE SELLER and THE BUYER agree that the present contract determines and includes the initial offers presented verbally or in writing, directly or indirectly, thus being this contract the only source of obligations between them.

TERMS, CONDITIONS AND RESTRICTIONS OF THE "TENDEROS ON VACATION" PLAN


The objective of the On Vacation Shopkeepers Plan campaign is to motivate shopkeepers in Colombia to implement the sales of tourism plans. On Vacation will pay an economic incentive for the concept of effective sales, that is to say, that people who have purchased with the code assigned to each shopkeeper, quote, buy and pay for an all-inclusive plan or accommodation in the destinations of the On Vacation portfolio.


HOW TO WIN GIFTS?

  • Sign up for the Tenderos Plan with an On Vacation sales manager or at https://www.onvacation.comm/plan-tenderos.
  • The shopkeeper earns rewards every time a person purchases their vacation or accommodation plan, with their assigned code, from their store or establishment.
  • The shopkeeper plan only applies to shopkeepers enrolled in the Shopkeepers On Vacation Plan. It does not apply to employees, commercial advisors, brokers and/or Free Lance of TOUR VACATION HOTELES AZUL S.A.S. BIC, licensee of the ON VACATION brand, or their relatives up to the fourth degree of consanguinity, second degree of affinity and first civil degree.

REGISTRATION PLAN FOR SHOPKEEPERS ON VACATION

  • The registration of the Shopkeepers in the plan and the access to the benefits granted by the same, are subject to the terms and conditions established by TOUR VACATION HOTELES AZUL SAS BIC who reserves the right of registration, access, use and exclusion of the plan.
  • Registration to the Shopkeepers On Vacation plan is free of charge.
  • The registration may be made by any natural person of legal age with a Colombian citizenship card or foreigner's card issued in Colombia who is the owner of a store, mini market or similar commercial establishments.
  • To register in the Shopkeepers Plan, the shopkeeper must provide the data requested for this purpose and authorize the processing of his personal data.

PERSONAL DATA PROTECTION CONDITION
The persons who register as Shopkeepers, under the terms of Statutory Law 1581 of 2012 and its regulatory decrees, authorize the dissemination of their full names, testimonies, voices and/or images by the media and in the manner deemed appropriate by the organizer, for commercial and advertising purposes, without the right to any compensation or economic consideration, during the term of this activity and until three (3) years after the end of the same.
Participation implies consent for the personal data of the participants to be included in the organizer's databases, as well as the authorization for the automated processing of such data or information, as well as for its use in connection with the commercial activity developed by the organizer and/or any of its subsidiaries or affiliates.
In relation to the personal data collected and processed by the organizer and in accordance with Colombian law.
Persons who register as Shopkeepers have the right to:

  1. Know, update and correct your personal data. This right may be exercised, among others, in relation to information, partial, inaccurate, incomplete, divided, misleading information or whose treatment is prohibited or not authorized by your participation.
  2. Require proof of consent given to the organizer of the activity for the collection and processing of personal data.
  3. To be informed by the organizer about the use that has been made of their personal data.
  4. To revoke the authorization given to the organizer for the processing of your personal data.
  5. Ask the organizer to be removed from its database.
  6. To have access to your personal data that the organizer has collected and processed with your authorization.
  7. Exercise their right to have their data deleted. In the event that participants exercise their right to have their data deleted, their participation in the activity will be automatically disqualified.

  9. The participants in the Tenderos Plan authorize the application of the privacy and confidentiality policies of personal data established in http://www.onvacation.comm/ and therefore with the participation in the activity: they grant free, voluntary, informed and express authorization for the processing of their data.

AWARDS

  1. For each effective sale with the respective code assigned to the third party, the shopkeeper will receive 7% commission of the value of the plan purchased before charges, supplements and taxes. The value of the commission will be directly deposited in the bank account of the shopkeeper's choice. For this purpose, it is important to note that On Vacation's ChargeBack Policy will apply.
  2. For every 15 effective sales the shopkeeper receives a trip for 2 people to one of these destinations: San Andres, Amazonas, La Guajira or Santa Marta (Mendihuaca). To participate for this prize only applies to referrals of all-inclusive plan.
  3. Every 6 months an international trip for 2 people to one of these destinations Cancun, Cuba, Ecuador or Dominican Republic will be awarded to the shopkeeper with the most effective sales at national level. Only shopkeepers with more than 20 effective sales registered between full plan and lodging will participate.

In case of having Shopkeepers with the same amount of effective sales. The winner will be defined by the sum of all sales. The shopkeeper with the highest number of sales in Colombian pesos will be the winner.


CONDITIONS AND RESTRICTIONS OF THE TRIPS DELIVERED AS PRIZES:


The plans include: Air tickets, lodging according to the current travel cycle, full meals, breakfasts, lunches and dinners (subject to hotel and selected destination), Assist Card, CSI (Charges, Supplements and Taxes) Does not include: Entrance to tourist sites, receptive services and unrelated food, entrance card to San Andres, transfers airport - hotel - airport in San Andres, entrance contribution to Leticia, pro-development contribution to La Guajira. Subject to area and hotel availability, service conditions and restrictions of law in force. Not applicable for travel during high season, fairs or events.

  • The winner will have 1 year from the date of issuance of the travel certificate to make use of it.

TOUR VACATION HOTELES AZUL S.A.S. BIC licensee of the ON VACATION brand may modify the terms and conditions of the campaign at any time, either permanently or for a limited time.


If the award plan changes or is definitively cancelled, it will be announced through at least one of its communication channels.

MECHANICS:


For each sale that the participant, whose legal representative must be of legal age, enters between April 15, 2024 and December 15, 2024, with a value equal to or greater than Five Million Pesos ($5.000.000) M/CTE COP, the travel agencies will be granted strips to participate in the drawing for 2 Honda PCX 160 Model 2024 motorcycles and 7 certificates of tourist products of the On Vacation brand for $5.000.000 each.

  1. Participants: Travel Agencies throughout the country that are registered as "agency" in Osiris Reservation System, that their legal representatives are of legal age, that commercialize TOUR VACATION HOTELES AZUL S.A.S. BIC tourist plans and that have an active travel agency RNT (National Tourism Registry) as of the date of the sweepstakes will participate.
    They will be consulted according to the information provided by the "Osiris" system on the sales of tourist plans TOUR VACATION can clearly and objectively determine the reservations entered, the total value and the client to whom they correspond.
  2. One strip will be assigned for each $5,000,000 up to the total value of each reservation.
  3. Each slip must contain the corresponding consecutive number, name of the agency, Nit, name of the agency representative, e-mail, telephone, number of the reservation that originates its delivery and the total value of the reservation registered in the Osiris system.
  4. Reserves with a total value of less than 5 million pesos and balances between reserves are not accumulative to enter the contest.
  5. According to the information provided by the "Osiris" system on the sales of touristic plans, TOUR VACATION can clearly and objectively determine the bookings entered, the total value and the agency to which they correspond.
  6. During the first 8 working days of each month, Tour Vacation Hoteles Azul SAS will review the sales managed by all travel agencies and will export the relevant list structured according to the parameters described above for the assignment and printing of strips for the raffle.
  7. The assigned strips will be deposited in the ballot box designated for this purpose by TOUR VACATION at the main office in the city of Bogota: CRA 46 - 94- 73, which will be sent by each of the participating agencies from the beginning of the promotion until December 15, 2024 at 12:00 am midnight.
  8. The raffles will be carried out under the supervision of a delegate of raffles and contests of the district secretary of government of the Mayor's Office of Bogota. On this day and randomly a strip will be chosen by an official of TOUR VACATION HOTELES AZUL SAS BIC.
  9. The reservation listed on the booking form must be immediately validated in the OSIRIS system, which must not be marked with the status "CANCELLED" at the time of validation. If the ticket is cancelled, it will be discarded and a different ticket will be chosen until the above mentioned is complied with.
  10. In addition to the above, it must be validated that the total value of the reserve (related in each ticket) at the date of the drawing is not less than five million pesos $5.000.000; that is to say, in case of having presented decreases in its total value due to possible adjustments, the minimum amount to be able to participate must be maintained. If there is evidence of decreases where the final total value of the reservation is less than five million pesos, the ticket will be discarded and a different one will be chosen until the aforementioned is complied with.
  11. The chosen ticket that complies with the above will determine the agency selected to be the winner of the prizes drawn on the following dates and times:

  12. Once a ticket is selected, an official or representative of the company will immediately contact the agency by telephone and will inform the agency of the fact in order to coordinate all the respective procedures for the delivery of the prize.
  13. If the first selected person does not answer the telephone in the first five (5) attempts, in front of the delegate of the District Secretary of Government of Bogota, a new draw will be made immediately in the presence of the delegate, until one of the selected persons who meets the conditions answers to provide the information.
  14. In order to guarantee the prize is delivered, once the possible winner of the drawing is contacted, four (4) possible alternate winners will be chosen in the presence of the Delegate, the alternates in their respective order will be contacted as possible winners, in the following month of having contacted the main winner, in case the main winner does not generate the acceptance of the prize through email or does not show up to accept his prize, or does not comply with the requirements to receive the prize. The total value of the reserve (related in each ballot) at the dates of the drawings must not be less than five million pesos $5,000,000; that is to say, in case of having presented decreases in its total value due to possible adjustments, the minimum amount to be able to participate must be maintained.
    4. Employees, commercial advisors, brokers and/or Free Lance of TOUR VACATION HOTELES AZUL S.A.S. BIC, licensee of the ON VACATION brand, and their relatives up to the fourth degree of consanguinity, second degree of affinity and first civil degree will not be considered as participants.
    5. The prizes offered in this campaign are NOT redeemable for cash, cannot be subject to endorsement, and are personal and non-transferable.
    6. The winner will be responsible for the payment of the occasional gain tax.
    7. Only persons of legal age may participate.
    8. Each winner, in order to be entitled to receive his/her prize, must prove and/or provide:

      3. The Legal Representative or attorney-in-fact must present original identity document (natural person) and original authenticated power of attorney in case of being an attorney-in-fact.

  2. THE AWARDS

    5. In the event of any change or operational adjustment, the corresponding change may be processed for another product or service of the brand (subject to air and hotel availability).
    6. Applies to all seasons and all eligible destinations at the time of application.
    7. Not applicable to be accumulated with special rate authorizations or discounts.
    8. The reservations entered and that have the certificate to be delivered as means of payment will be commissionable as normal for the agency according to the parameters established in the "Travel Agency Commission Policy" and must be entered through the Revenue Channel.
    9. The certificate to be delivered must be accepted during the month following the month in which the winner was contacted and may be redeemed by the winner for one year from the date of the drawing. If not used within this period, the certificate will expire and there will be no further claims or requests.
    10. If the winner of the Honda PCX 160 Model 2024 motorcycle does not reside in the city of Bogota, the winner must assume the transportation costs from Bogota to his/her city of residence. The motorcycle will be delivered in the city of Bogota.

  4. VALIDITY VIGENCIA

On Vacation Tik Tik Card

The terms and conditions set forth below (hereinafter, the "TERMS AND CONDITIONS") shall be understood as read, understood and accepted by each CLIENT with the purchase of the TIKTIK CARD. If he/she does not agree with them, each CUSTOMER has the option not to purchase or not to use the TIKTIK CARD.

CHARACTERISTICS:

Price of plastic: $20,000 pesos

Recharges starting at $50,000 pesos and for multiples of $50,000 pesos.

The maximum balance on the TikTik Card is $2,000,000 pesos.

For exclusive use in "On Vacation" retail establishments.

  1. DEFINITIONS

The terms listed below shall have the meaning assigned to them in this Section or as assigned to them elsewhere in these TERMS AND CONDITIONS, whether the term is used in the singular or plural, masculine or feminine:

"Enrollment assistant": Receptionists, brokerage sales advisors or On Vacation employees who will sell and reload TikTik Cards.

"CUSTOMER": Any natural person who is a user and/or acquires products and/or services from ON VACATION.

"Identity Document": It is the identity document that proves the age of majority of the CLIENT (e.g.: citizenship card, foreigner's card, passport, driver's license, military passbook, among others).

"Enrollment": Has the meaning given to it in Section II, Section 2.6 of these TERMS AND CONDITIONS.

"On Vacation Business Establishments": These are the bases, points of sale, commercial stands and offices nationwide and hotels of the "On Vacation" chain in the cities of Manaure - La Guajira, San Andres Isla, Leticia - Amazonas and Girardot - Tolima, which have dataphones.

"ON VACATION": Tour Vacation Hoteles Azul S.A.S. commercial company with NIT. 900.304.940-9

"Portal": On Vacation's website, https://www.onvacation.com/, where it will be possible to purchase, among other products established by ON VACATION.

"Food and beverage outlets": refers to restaurants, pubs and bars in On Vacation retail establishments that are not included in the company's plans and require payment.

"Recharges": Are the advances with which the TIKTIK CARD is loaded and/or recharged for its use, in accordance with the amounts established by ON VACATION and the provisions of Section IV of these TERMS AND CONDITIONS. The minimum and maximum permitted values of the Recharges may be modified by ON VACATION at any time, at its discretion, and will be informed to the public through the Portal and/or other means that ON VACATION may have for such purpose.

"TIKTIK CARD": Means of rechargeable payment exclusive to ON VACATION with which the CLIENT may, as determined by ON VACATION: (i) purchase at special prices the products and/or services available at any of the food and beverage points of sale of the On Vacation hotels (ii) purchase tourist products offered at the On Vacation Merchant Establishments nationwide. The TIKTIK CARD can be acquired by the CLIENT at the On Vacation Merchant Establishments or at the place that ON VACATION provides for such purposes, and is subject to these TERMS AND CONDITIONS.

II. PURCHASE OF THE TIKTIK CARD

2.1. The TIKTIK CARD may be purchased at the On Vacation Commerce establishments or at the place provided by ON VACATION for such purposes.

2.2. The sale of TIKTIK CARDS shall be subject to their availability at each On Vacation commercial establishment.

2.3. It is essential that the CUSTOMER is of legal age on the date of acquisition of the TIKTIK CARD, which must be proven by presenting his/her Identity Document, from which the following basic data will be taken: names, surnames, date and place of birth, and identification number, with which the TIKTIK CARD will be associated.   

2.4. At the time of purchase, it is essential that the CUSTOMER: (i) pays the price of the plastic of the TIKTIK CARD according to the current value at the time of purchase of the same, determined by ON VACATION, and (ii) performs the TIKTIK CARD RECHARGE in accordance with the RECHARGE values established by ON VACATION. The minimum and maximum Refill values may be modified by ON VACATION at any time, at its discretion, and will be informed to the public through the Portal and/or through other means that ON VACATION may have for such purpose.

2.5. The price of the TIKTIK CARD plastic may be modified by ON VACATION at any time, prior communication to the public through the Portal and/or any other means that ON VACATION has available for these purposes.

2.6. The enrollment assistant shall activate the TIKTIK CARD before delivering it to the CUSTOMER (hereinafter, the "Enrollment"). The Enrollment requires that the CUSTOMER: (i) recharge the TIKTIK CARD with the minimum RECHARGE value established by ON VACATION, and (ii) provide his/her contact information to be included in ON VACATION's database, so that he/she can be easily contacted to inform any news, send the receipt of payment of the recharge made and for ON VACATION to give the corresponding treatment, in accordance with the following paragraph. Consequently, it will be necessary that the CUSTOMER, at the time of purchasing the TIKTIK CARD, and in order to make proper use of his TIKTIK CARD, provides his personal contact information (including, among others, his cell phone number and e-mail). 

The CLIENT shall provide truthful and complete data and, with the acquisition of the TIKTIK CARD, authorizes ON VACATION to treat them in accordance with the provisions of its Privacy and Confidentiality Policy of Personal Data and Law 1581 of 2012 and other complementary rules. For more information on the Privacy and Confidentiality Policy of Personal Data of ON VACATION, the CUSTOMER may consult it in the Portal at the following link: https://www.onvacation.com/privacidad-confidencialidad

2.7. The CLIENT, as the owner of his/her personal data, shall have the rights granted by law for these purposes, including: (i) know, update and rectify their personal data, as well as oppose the processing thereof; (ii) request proof of their authorization to process personal data; (iii) be informed of the use given to their personal data; (iv) file before the Superintendence of Industry and Commerce complaints for violations of the provisions of Law 1581 of 2012 and other rules that modify, add or supplement it; (v) revoke the authorization and/or request the deletion of their data; and (vi) access free of charge to their personal data.

2.8. Once the enrollment process is completed, the TIKTIK CARD will be delivered to the CUSTOMER for its use.

III. USE OF THE TIKTIK CARD

3.1. The TIKTIK CARD has a magnetic stripe that allows its interaction with ON VACATION's transactional system database, in which an updated record of the CLIENT's information will be kept, as well as the values of the Recharges that may be used for the payment of goods and/or services to be purchased at ON VACATION stores, as well as for the payment of other products and/or services offered by ON VACATION, including those stores with which it establishes alliances and loyalty programs of its brands, if any.

3.2. The TIKTIK CARD may be used upon presentation at authorized food and beverage outlets and On Vacation commercial establishments.

3.3. The CUSTOMER shall be responsible for the proper use, conservation and custody of the TIKTIK CARD, and for all transactions made with it, including those made by third parties, with or without its consent.  

3.4. The TIKTIK CARD operates through an electronic reader, by means of which the price of the product and/or service determined by ON VACATION is discounted at authorized food and beverage points of sale and On Vacation Commerce establishments. The CLIENT shall assume the taxes, duties and levies applicable to the products and/or services that may be acquired with the TIKTIK CARD.

3.5. Once the payment of a product and/or service has been made with the TIKTIK CARD, the CUSTOMER will be given a receipt indicating the value of the purchase.

3.6. The CLIENT may, in the same purchase, acquire products and/or services with the TIKTIK CARD and with a different means of payment.  

3.7. In the event of theft or loss of the TIKTIK CARD, the CUSTOMER will be responsible for it, understanding that the TIKTIK CARD is a bearer card. The value of the consumption of the TIKTIK CARD by third parties will be assumed exclusively by the CUSTOMER.

ON VACATION, will not be responsible for the deterioration, loss, theft, adulteration, fraud or damage with or in the TIKTIK CARD, in the events that the TIKTIK CARD cannot be read by the data-phones will be the responsibility of the CLIENT and the balance that cannot be verified will not be subject to reimbursement, endorsement or refund.

3.9. If the TIKTIK CARD is damaged or becomes unusable due to actions or omissions beyond the control of ON VACATION, the CUSTOMER must request its replacement at ON VACATION's reception, the balance that cannot be verified will not be subject to reimbursement, endorsement or refund.

3.10. To replace the TIKTIK CARD when it has been lost, stolen or is damaged or unusable, the CUSTOMER must present his/her Identity Document, as well as pay the current price for the new plastic with any of the means of payment enabled by ON VACATION.

3.11. The TIKTIK CARD with manufacturing defects may be replaced, at no cost to the CUSTOMER, within one year after its activation.

IV. BALANCES AND RECHARGES

4.1. Refills of the TIKTIK CARD shall be made by the CUSTOMER: (i) using any means of payment that ON VACATION has enabled at that time for such purposes, and (ii) in the places that ON VACATION, at its discretion, determines for such purposes.  

4.2. For each Recharge, the CUSTOMER will receive a voucher containing the information related to the amount paid, object of the Recharge.

4.3. Recharges may only be made in accordance with the amounts established by ON VACATION, which may be modified at any time and will be informed to the public through the Portal and/or through other means that ON VACATION may provide for such purpose.

4.4. Recharges are not subject to refund, are subject to the application of their expiration in accordance with these TERMS AND CONDITIONS, and may only be used in the manner described in these TERMS AND CONDITIONS.

4.5. THE BALANCES OF THE TIKTIK CARD WILL BE VALID FOR THREE (3) YEARS FROM THE TIME OF THE INITIAL LOAD OR THE LAST RELOAD OF THE RESPECTIVE BALANCE, WITHIN WHICH TIME THE BALANCE MUST BE USED OR IT WILL BE LOST. The above may be modified at any time by ON VACATION, which will be informed to the CUSTOMERS through the Portal, or any other means determined by ON VACATION for such purposes.

4.6. The CUSTOMER may consult his/her balances and expiration dates at any On Vacation commercial establishment, On Vacation commercial establishments or other means that ON VACATION has available for such purpose.

V. PRODUCT BLOCKING

5.1. In order to protect its CUSTOMERS, ON VACATION reserves the right to audit the CUSTOMERS' consumption behaviors made with the TIKTIK CARDS associated to their Identity Card, at any time and without the need to notify the CUSTOMER in accordance with its SAGRILAFT AND PTEE policies, in which the following behaviors are evidenced

5.1.1. Security alert for fraud and/or any unlawful act, fraud and/or any unlawful act, non-compliance, non-conforming activity or conduct and/or violation of: (i) the TERMS AND CONDITIONS and/or (ii) of the TIKTIK CARD and/or other ON VACATION products; and/or

5.1.2. Fraud, non-compliance, non-conforming activity or conduct and/or violation of the terms and conditions of any ON VACATION activities, campaigns and/or promotional games; and/or

5.1.3. Any irregular conduct, or suspicion of irregular conduct, including the use of the TIKTIK CARD to purchase products and/or services for resale or in the purchase of the same for third parties, of falsehood, or of bad faith employed by the CUSTOMER in connection with the use of the TIKTIK CARD; and/or  

5.1.4. When at the discretion of ON VACATION it is identified that any CUSTOMER incurred, incurs or has incurred in acts and/or conduct harmful or potentially harmful to any asset of ON VACATION, regardless of whether or not it is determined that the CUSTOMER is liable of any nature; and/or

5.1.5. Failure to comply with any other applicable rules and/or regulations, including, but not limited to the TERMS AND CONDITIONS.

Likewise, ON VACATION reserves the right to take any legal action it deems appropriate to recover any damages that may have been caused to it, including legal expenses incurred in the action involving the exercise of the aforementioned right, as a consequence of the conduct described above.

5.3. CUSTOMERS agree to the foregoing and authorize ON VACATION to: (i) use their information for the aforementioned purposes, and (ii) include such information in risk information systems and/or possible fraud and/or illicit acts UIAF or any other applicable.

VI. OTHER TERMS AND CONDITIONS

6.1. ON VACATION reserves the right to modify, cancel or replace in its entirety these TERMS AND CONDITIONS, at any time, including the benefits of the TIKTIK CARD, by publishing such modifications or cancellations in a visible place on the Portal.

6.2. If ON VACATION, for the benefit of the CLIENT, refrains from applying or applies in a different manner any of these TERMS AND CONDITIONS, this shall not constitute a waiver by ON VACATION or a modification, cancellation and/or termination of these TERMS AND CONDITIONS.

ON VACATION may at any time create marketing strategies and loyalty programs for the segmentation and categorization of CUSTOMERS, which may generate card categories and differential and exclusive reward plans for each of the newly defined categories.

ON VACATION may change, at any time, the conditions to access the benefits, as well as the criteria for categorization of the CUSTOMERS. Consequently, CLIENTS may belong and cease to belong to a specific category, under the conditions established for such purpose. In any case, changes in this regard will be informed to the public through the Portal and/or through other means that ON VACATION may have for such purpose.
