On Vacation Experience Membership

General regulations and conditions for using the On Vacation Experience membership

This document forms part of the On Vacation Experience timeshare membership agreement, acquired by Members who wish to enjoy vacation periods using the MEMBERSHIP described in the AGREEMENT. Anyone who subscribes or registers under the terms presented herein is obligated to carefully read the document detailed below, thereby committing to fulfill the obligations described herein, which have been ratified by signing the On Vacation Experience personal timeshare membership agreement.

 

ARTICLE I. PURPOSE OF THIS REGULATIONIt is necessary to determine two main objects, namely:

  • To implement all means, forms and procedures, in addition to the rules and regulations that must be observed, in order to establish the logical, rational and appropriate application of the MEMBERSHIP named ON VACATION EXPERIENCE.
  • Guarantee the rights of Affiliates or Users.

ARTICLE II. DEFINITIONSIn order to establish clear guidelines, the scope of the terms to be used between the parties is determined in advance, as follows:

  • ON VACATION EXPERIENCE MEMBERSHIP. Hereinafter referred to as THE MEMBERSHIP, consists of the purchase, acquisition, or appropriation of a personal timeshare membership, meaning it does not transfer real or property rights. Depending on the category and subcategory acquired by the member, they receive nights of accommodation in the hotels corresponding to their membership. They also receive a limited number of annual opportunities to book and enjoy accommodation in hotels that are not part of their membership but are within THE COMPANY's portfolio. Furthermore, they acquire a series of special benefits, in accordance with the terms and conditions established in these Regulations and the contract. Given THE COMPANY's affiliations with other companies dedicated to offering tourism services, THE COMPANY may occasionally offer THE MEMBER access and special prices on products such as car rentals, tours, accommodation in hotels that are not part of the On Vacation chain, airline tickets to destinations not operated by THE COMPANY, among others.
  • THE COMPANY. This is the name given to TOUR VACATION HOTELES AZUL SAS; a company with its main address in the city of Bogotá, DC, registered on August 10, 2009 under number 01318613 of Book IX, registered in the Commercial Registry of the Bogotá Chamber of Commerce, under number 01920679, with NIT. 900.304.940-9, which is the legal entity in charge of THE MEMBERSHIP, responsible for its formation, structuring, direction, operation, exercise and purpose, with National Tourism Registry (RNT. 22675).
  • AFFILIATE. Natural person in whose name the MEMBERSHIP is held.
  • GUEST. Natural person who may accompany the member, paying a special fee, if the membership category and subcategory allows for guests.
  • USE. Members who have paid 10% of the membership fee and are up-to-date on their payments may request a reservation fifteen (15) calendar days in advance to enjoy accommodations subject to availability for memberships. There are 100 spaces available per night for all hotels in the chain (subject to hotel capacity). This accommodation can be used during the nights the membership is valid at the hotels included in their membership. However, the MEMBER must first check hotel availability with THE COMPANY and pay for any special services or Continental breakfast if the chosen hotel operates under those terms. The MEMBER is hereby informed that, pursuant to Article 17 of Decree 2762 of 1991, tourists may only stay on San Andrés Island for a period of four (4) continuous or non-continuous months per year. Therefore, once the MEMBER has fulfilled this legal requirement, they may continue to use the accommodations at other hotels that are part of their membership type and where Colombian law does not impose restrictions on length of stay or movement. Similarly, the maximum stay at each hotel is defined in Decree 2590 of 2009, such that the maximum stay per reservation will be thirty (30) calendar days at each hotel.
  • MAXIMUM USAGE PER YEAR. Number of times per year allowed to use the membership at the specified hotels according to the membership class and subcategory selected by THE MEMBER.
  • SPECIAL SERVICES. This refers to the set of additional services beyond accommodation, which entitle the MEMBER and their guests to receive main meals, soft drinks and sodas (if the selected hotel offers this service), an open bar (according to the hotel's hours), and hotel taxes. The additional price for SPECIAL SERVICES will be paid upon confirmation of the reservation, only if this service is mandatory at the hotel where the MEMBER intends to use their membership, and subject to the specific conditions of each hotel. It is clarified that the SPECIAL SERVICES and CONTINENTAL BREAKFAST do NOT include airfare, airport-hotel-airport transfers, tours, medical assistance cards, tourist cards, or intercity transportation.
  • CONTINENTAL BREAKFAST. This is the name given to the food provided to the MEMBER as the only meal included in the morning, in those hotels that do not operate under the SPECIAL SERVICES standard.
  • ADDITIONAL SERVICES. This is the set of services different from SPECIAL SERVICES and CONTINENTAL BREAKFAST, as these consist of services that are not necessarily linked to accommodation, such as vehicle rental, ticket issuance, ground transfers, tours at the destination, among others.
  • RESERVATION. This is the blocking of spaces by THE COMPANY at the express request of THE MEMBER to provide the accommodation service, specifying the services to be provided, the people who will be part of the reservation and the other applicable conditions and characteristics.
  • VACATION EXCHANGE MEMBERSHIP. THE COMPANY is affiliated with a company dedicated to promoting Vacation Exchanges “VACATION EXCHANGE CHAIN”, in order to offer its Members the possibility of depositing their nights of accommodation, after their transformation, to apply and enjoy their right in a destination and hotel different from those attached to THE MEMBERSHIP, in an equivalent housing unit in the period set and under the conditions and procedures established by the Vacation Exchange Chain.
  • VACATION EXCHANGE CHAIN. It is the legal entity whose purpose is to promote and mediate the exchange of vacation periods between its clients and provide them with additional services.
  • ON VACATION EXPERIENCE TIMESHARE VACATION MEMBERSHIP AGREEMENT. This is the agreement entered into between THE COMPANY and THE MEMBER, which establishes the general conditions and terms that give rise to these Regulations; hereinafter THE AGREEMENT.
  • MEMBERSHIP FEES. This is a one-time sum of money paid by the MEMBER, which covers all expenses incurred by the company to enter into the timeshare contract, and everything related to the membership during the sales phase, such as leases, insurance, payroll, commissions, advertising, stationery, utilities, and other related items.
  • MONTHLY MAINTENANCE FEE. This is the fixed monthly amount that THE MEMBER must pay to cover the maintenance of the hotels where they can use their MEMBERSHIP. This charge will be generated from the thirteenth (13) month of the Membership until the termination of the contract.
  • ACCOMMODATION SEASON. High season is defined as Holy Week, which runs from the Friday before Holy Thursday to Holy Saturday; New Year's, which runs from December 20th of each year to January 15th of the following year; and holidays, which are considered holiday season when your travel period includes a Friday, Saturday, Sunday, and Monday holiday. The rest of the year is considered low season.

ARTICLE IIIUSE AND OPERATION OF MEMBERSHIP SERVICES: Upon signing THE CONTRACT, THE MEMBER freely and voluntarily chooses the category and subcategory of MEMBERSHIP he/she acquires, according to his/her economic capacity and need for accommodation.

  • USE OF MEMBERSHIP. To use the MEMBERSHIP during the term of the AGREEMENT, the MEMBER must first meet the following requirements: 1) Have paid the membership fees. 2) Have paid 10% of the total membership value. 3) Be up-to-date on the monthly maintenance fee. 4) Be up-to-date on the payment of the MEMBERSHIP financing installments. 5) Have paid the cost of special services and continental breakfast, if the chosen Hotel operates in that manner.
  • PROHIBITION OF MULTIPLE RESERVATIONS. The MEMBER is expressly prohibited from making two (2) or more reservations that have the same check-in date at the Hotel and that have the same tourist destination, as this may result in the violation of increasing the number of passengers allowed.

PARAGRAPHThe hotels linked to the MEMBERSHIP are currently those listed below; these may vary without implying any modification to the terms of the Contract; any changes that may occur correspond to hotel infrastructures of equal or better category than the current ones, in which case the MEMBER will be given timely notice.

 

The hotels to which the MEMBER will have access may be of the following types:

  1. Light (Continental breakfast. The rest of the day, enjoy local and international cuisine at nearby restaurants around the hotel (not included). 
    • San Andrés: Hotel Magic Hill (Breakfast not included – Accommodation only)
    • San Andrés: Coral Flower Hotel
  2. Express (Breakfast and dinner included. Restaurant and bar services available at an additional cost during set hours) 
    • San Andrés: Blue Reef Hotel
    • San Andrés: Blue Tower Hotel
    • San Andrés: Hotel Blue Toné
  3. Vacation (Full board included: Breakfast, lunch, dinner, bar at an extra cost during hotel hours. Additional service of à la carte restaurant and bar, entertainment areas and swimming pool) 
    • Guajira: Hotel Wayira Beach (Drinks not included)
    • San Andrés: Hotel Blue Cove
    • Amazon: Hotel Amazon
    • Girardot: Hotel Girardot Resort (Drinks not included)
  4. Exclusive(Full board included: Breakfast, lunch, dinner. Drinks not included) 
    • San Andrés: Hotel Acantilado de la Tierra

ARTICLE IV. RESERVATION AND REQUEST PERIODS Handling of periods, requests and confirmation of reservations.

  • RESERVATION REQUEST PERIODS. The MEMBER, wishing to request a hotel reservation, must inform THE COMPANY using any of the following contact channels, at least fifteen (15) calendar days prior to the check-in date at the Hotel, to request the reservation. The MEMBER may contact THE COMPANY through the following channels:
  • Once the MEMBER'S request is received, THE COMPANY will confirm the reservation, provided that THE MEMBER is up to date on their payments to THE COMPANY. These requests are subject to accommodation availability and will be processed in strict chronological order of submission by the Members.

ARTICLE V. RESERVATION CONFIRMATION. To confirm a reservation, THE COMPANY will verify the following conditions:

  • That THE MEMBER has paid THE SOCIETY the full price of THE MEMBERSHIP, or at least ten percent (10%) of it or the value indicated by the offered rate, at the time of requesting the reservation, additionally, must be fully up to date with THE SOCIETY in all respects.
  • That THE MEMBER has paid for THE SPECIAL SERVICES or the corresponding CONTINENTAL BREAKFAST, when using the hotels affiliated with THE MEMBERSHIP that operate in that modality.
  • That there is room availability at the hotel and on the requested dates.
  • Children aged 2 and over are considered adults when determining the price to be paid if they are a GUEST, as well as when determining the accommodation capacity at the time of making the reservation.
  • The maximum number of people per reservation will depend on the membership category and subcategory that the MEMBER has acquired.

ARTICLE VI. CHANGES, UPDATES TO HOTEL RESERVATIONS AND CANCELLATION PENALTIES: In case of modification of the hotel reservation, the conditions of the changes and updates table will apply to the AFFILIATE, with the readjustment of the rate for changes or other additions that will be settled at the time. In the event of cancellation of the reservation, the AFFILIATE must assume the collection of the penalties as appropriate.

  • In the event that airline tickets have been processed through THE COMPANY to use THE MEMBERSHIP, and flight cancellations attributable to THE MEMBER occur, the penalties established by THE COMPANY and/or the airline will be applied and charged to THE MEMBER.

PARAGRAPH: FLEXIBLE RESERVATIONS – If you book your vacation, you can change your travel dates to travel whenever you choose without penalty. All fares with the Flexible Booking seal qualify for this traveler-friendly policy. This applies to bookings made between March 19 and November 30, 2020.

 

You can change the date as many times as necessary due to the health emergency, free of charge. For other reasons, the first change will be free of charge.

 

In case of requiring further changes or notifying the change less than 45 days before the travel date, the passenger must assume the penalty and fare difference if applicable.

 

You must make the change no later than 45 calendar days before the travel date.

 

You can reschedule your booking or voucher to travel on available dates up to 1 year after your original travel date or up to one (1) year after the end of the health emergency.

 

ARTICLE VII. CHECK-IN AND CHECK-OUT: Check-in and check-out times are regulated by each hotel and must be strictly adhered to. Generally, check-in is from 17:00 PM and check-out is at 13:00 PM. Upon check-in, the MEMBER must present the reservation confirmation document (Hotel Voucher) where required and sign an inventory list of the furniture and accessories in the assigned room. Check-out must take place before the designated check-out time, as established by the hotel. At that time, the MEMBER must pay for any services rendered that are not included in the SPECIAL SERVICES or CONTINENTAL BREAKFAST and will be responsible for the condition in which the furniture and accessories of the room are left, as well as any other damage that may have been caused to the hotel facilities.

 

ARTICLE VIII. MEMBER RIGHTS: The MEMBER has the following rights with respect to THE MEMBERSHIP:

  • Use the MEMBERSHIP under the terms and conditions agreed upon in these Regulations and in the CONTRACT signed between the MEMBER and the COMPANY. Additionally, you may be eligible for special discounts on SPECIAL SERVICES or CONTINENTAL BREAKFAST as established by each hotel.
  • To make use of the Vacation Exchange membership to which THE COMPANY is affiliated, after fulfilling the requirements established by the respective Vacation Exchange Company, this Regulation and THE CONTRACT signed between THE COMPANY and THE AFFILIATE.
  • The MEMBER has the right to know and request information regarding the total value of the membership, including the statement of account.
  • Use the property and areas of the hotels linked to THE MEMBERSHIP, according to their nature and ordinary purpose, with the necessary care and moderation established for that purpose.
  • The MEMBER has the right to use it in any of the hotels affiliated with the MEMBERSHIP, provided they comply with the reservation rules established in this Regulation and subject to room availability.

ARTICLE IX. MEMBER'S OBLIGATIONS: The MEMBER'S obligations with respect to THE MEMBERSHIP

  • Pay the corresponding price of THE MEMBERSHIP and the value of the AFFILIATION RIGHTS, in accordance with the terms of THE CONTRACT.
  • Pay the monthly maintenance fee for the hotels that are part of the portfolio.
  • Pay the value of the SPECIAL SERVICES or CONTINENTAL BREAKFAST, according to the hotel where you have made your reservation, if in those hotel establishments they operate permanently under those figures.
  • THE MEMBER will be jointly and severally liable for any shortages and damages caused to the assigned housing unit, its furniture or the common facilities of the hotel where THE MEMBERSHIP is used.
  • THE MEMBER must inform THE COMPANY about any breakdowns, defects or inconveniences that may occur in the room assigned to him at the Hotel where he is staying.
  • Every MEMBER must take care of, preserve and watch over all property, belongings and utensils, being responsible for his own actions, those of his spouse, those of his family in general and guests, even for slight negligence, in accordance with applicable laws.
  • Designate an address for notification purposes and promptly inform THE COMPANY in writing of any changes; the same applies to your email addresses.
  • During their stay at the hotel, allow for urgent works or repairs to be carried out in the housing unit and their eventual transfer to another unit of the same characteristics, should they arise.
  • Use the facilities of the hotels affiliated with THE MEMBERSHIP at the scheduled times and under the conditions established for this purpose by each of the hotels.
  • Report any valuables you are carrying when checking in at the Hotel where you are staying to use your timeshare membership, so that the Hotel and THE COMPANY will only be responsible for those goods and items reported and left in custody.
  • Maintain appropriate behavior for himself and his companions while staying at hotels that are part of the membership, so that if THE MEMBER or one of his companions commits acts that may be classified as contraventions of the National Police Code, he may be removed from the hotel without any refund of money corresponding to the lodging period.
  • Submit to THE SOCIETY the report of situations that generate a complaint regarding non-compliance under the service, within forty-five (45) calendar days following the occurrence of the event, all in accordance with Law 300 of 1996 and Law 1480 of 2011.
  • Any others established by these Regulations.

ARTICLE X. PROHIBITIONS: THE AFFILIATE agrees not to perform any of the following:

  • To carry out, on one's own, physical modifications or remodeling, repairs, improvements, additions, alterations, removals or substitutions in the housing units or in the goods, areas and services of common use, or in the furniture found therein.
  • Occupying the respective housing unit by a number of people that exceeds the maximum occupancy capacity established by the hotel and also previously confirmed by THE COMPANY in the corresponding hotel reservation.
  • Use in the premises and common or private areas of the hotels, equipment that generates sound or noise that disturbs any AFFILIATE, guest or visitor, at the discretion of the hotel operator.
  • Bringing animals of any kind into the hotel premises or common areas or into the accommodation unit.
  • Hanging clothes, towels, swimsuits or any other item on windows, terraces or any place that is exposed or visible to other parts of the hotel.
  • The MEMBER may not use the MEMBERSHIP for commercial purposes where they intend to obtain an economic profit; that is, use the MEMBERSHIP to resell or market vacation plans to the general public taking advantage of its benefits; if this infraction is detected, THE COMPANY will unilaterally terminate THE CONTRACT that covers this Regulation, without any payment of compensation, applying what is set forth in the terms of THE CONTRACT.
  • The MEMBER is advised that sexual exploitation in Law 679/01 and 1336/09, the exploitation and sexual abuse of children and adolescents in the country are punishable criminally and administratively, in accordance with current laws.

ARTICLE XI. OBLIGATIONS OF THE COMPANY: The COMPANY, in its capacity as administrator and operator of THE MEMBERSHIP, shall have the following obligations, which it may exercise directly or through third parties:

  • Respect the rights of THE MEMBER provided for in THE CONTRACT and in the Regulations, guaranteeing the use and enjoyment of the timeshare membership, in accordance with the accepted conditions and hotel availability.
  • To allow THE AFFILIATE to make use of the accommodation that corresponds to him, under the terms, conditions and deadlines agreed by THE AFFILIATE in THE CONTRACT and in the general conditions of THE MEMBERSHIP contained in this Regulation.
  • Hire the staff you deem necessary for the proper administration and operation of tourist services.
  • To execute and enforce the provisions of THE CONTRACT, these Regulations and current legal standards.
  • Collect the sums that must be paid by THE MEMBER.
  • To establish and inform about the operating rules of the hotels affiliated with THE MEMBERSHIP, the schedules, specific prohibitions other than those indicated in this Regulation and to issue the necessary regulations for their correct operation.
  • Initiate the necessary and pertinent actions when, due to the AFFILIATE or personnel under his charge, damages are caused to the hotels, and if the case arises, initiate processes against those persons who have caused damages.

ARTICLE XII. MEMBERSHIP RIGHTS: This sum of money intended to cover the expenses of the timeshare contract will not be refunded TO THE MEMBER, except in the events provided for by law.

 

ARTICLE XIII. VACATION EXCHANGE COMPANY: As an additional benefit for THE MEMBER, THE COMPANY will be affiliated, while THE MEMBERSHIP exists, with a Vacation Exchange Company, through which THE MEMBER has the option to deposit and use their nights of accommodation, in order to enjoy a destination different from those included within THE MEMBERSHIP in an equivalent vacation unit, within the period set and under the conditions established by the Vacation Exchange Company.

 

THE MEMBERSHIP will provide THE AFFILIATE, upon request, in accordance with the terms established in THE CONTRACT and in these Regulations, with a free membership for the term determined by THE CONTRACT to the Vacation Exchange Company, to effect the membership of the exchange.

 

All exchange processes will be governed by the terms and conditions of the subscription and membership agreement of the respective company.

 

PARAGRAPH: The exchange costs are the sole responsibility of THE MEMBER, as well as the costs of renewing the membership when it expires and THE MEMBER is interested in renewing it.

 

ARTICLE XIV. BREACHES: For this purpose, the following shall be understood as breaches by THE AFFILIATE or THE COMPANY:

 

NON-COMPLIANCE BY THE MEMBER: In the event of total or partial breach of the obligations undertaken by the MEMBER, the COMPANY may assume as a penalty the amounts paid by the MEMBER, up to the sum corresponding to the initial payment stipulated in the timeshare contract. The COMPANY will reimburse the amounts due to the MEMBER, representing the total stipulated price, after deducting the aforementioned penalty. Payments made for membership fees, special services, continental breakfast, maintenance fees, or other tourist services duly provided by the COMPANY will not be refunded. Refunded amounts will not give rise to additional financial compensation. The maximum period for the return of balances in favor of the MEMBER by the COMPANY will be one (1) month, counted from the date of termination of the contract. The following are also considered breaches:

  • To engage in any conduct within the hotel that constitutes an offense or is likely to be classified as unlawful.
  • Terminate the stay without paying the charges and/or additional services incurred by THE MEMBER or any of his companions.
  • Attempting to deceive the hotel where the MEMBERSHIP is used, by occupying a room with a number of people exceeding the maximum allowed and authorized in the Hotel Voucher.
  • To violate the rules set out in this Regulation.
  • Using the membership for commercial purposes.
  • BREACH OF CONTRACT BY THE COMPANY: The MEMBER may request termination of the Contract, provided they are current on their payments, in cases where applicable, due to a proven breach of obligations by THE COMPANY. In such cases, THE COMPANY will refund the updated value in the corresponding proportion of the MEMBERSHIP fee, deducting the days the service was available for use. The COMPANY will not refund the membership fees paid by the member, nor any fees for special services and continental breakfast, maintenance fees, or other tourist services duly provided by THE COMPANY. The refund period will be one (1) month. The parties agree that the amounts to be refunded will not be subject to any additional financial compensation.

ARTICLE XV. SANCTIONS: Failure to comply with the obligations or violation of the prohibitions, by THE AFFILIATE and/or GUEST, to any obligation established in these Regulations, will result in the application of the following sanctions:

  • Warning: For THE MEMBER, if the infraction was for the first time and did not cause any harm.
  • If the behavior that led to the reprimand is repeated, THE SOCIETY will proceed to deduct from the sums of money collected for the value of the membership, the value equivalent to the damage caused.
  • In the event of repeated offenses or violations, THE COMPANY may: Terminate THE CONTRACT entered into between THE COMPANY and THE MEMBER. In which case, the provisions of the preceding paragraph shall apply.

PARAGRAPH: Where applicable, in addition to the indicated sanction, THE MEMBER will pay the repair or replacement expenses that the hotel must incur to remedy the damages caused, as well as the costs and fees, including any applicable legal costs.

 

ARTICLE XVI. PROCEDURE FOR APPLYING SANCTIONS: THE COMPANY will impose the sanctions provided for in the previous Article, in accordance with the following procedure:

  • The Company will inform the Member in writing, at the address registered by the Member in the Contract or using the contact information provided, of any violations of these Regulations committed by the Member or their companions, attaching a cost estimate for repairs or replacements to the hotel, should any material damage have occurred, and indicating the applicable sanction. Upon receiving this notification, the Member will have ten (10) business days to respond, stating all arguments they wish to have considered and providing any supporting documentation they deem necessary.
  • THE COMPANY will review THE MEMBER's response and within a maximum period of five (5) business days will notify the MEMBER of the decision regarding the imposition of a sanction or acquittal, as the case may be. No appeals are permitted against this decision. XVI.III. The payment of the expenses for the repair or replacement incurred by the hotel must be made within a period of one (1) month from the moment THE COMPANY informs THE MEMBER of the amounts to be paid.
  • In the event that THE AFFILIATE fails to pay the amount owed, he/she will pay default interest which will be calculated on an annual basis, applying the maximum rate allowed by law, for each month or fraction thereof that the default lasts.
  • The MEMBER will be disqualified from enjoying the MEMBERSHIP for the entire duration of their non-compliance, even if they meet all other requirements for its use. If the MEMBER continues to be in non-compliance for three (3) months from the date of notification, the COMPANY may terminate the CONTRACT, regardless of any legal action it may take against the non-compliant member to collect the appropriate amounts and damages.
  • THE MEMBER is jointly and severally liable to THE COMPANY for the guests and other persons related to their reservation, for the damages caused to the hotels affiliated with THE MEMBERSHIP.

ARTICLE XVII. EXTENSION OF THE REGULATIONS: Everything stipulated in these Regulations for THE MEMBER regarding prohibitions and obligations, both those relating to the use of rooms and the goods and services of THE MEMBERSHIP, will also apply to GUESTS and other persons whom THE MEMBER allows to enjoy the accommodation.

 

ARTICLE XVIII. ASSIGNMENT: THE AFFILIATE may assign this Contract, after verification by THE COMPANY, since it is the individual characteristics of the contracting parties that motivate the signing of this, this business being a commercial agreement intuitu personae.

 

ARTICLE XIX. AMENDMENTS TO THE GENERAL MEMBERSHIP CONDITIONS: THE COMPANY will periodically update the Internal Regulations of the Timeshare Membership, which will be communicated to THE MEMBERS through electronic publication on THE COMPANY's website. Once the regulations with their updates are published, they will be the most recent version and applicable to all signed contracts.

 

ARTICLE XX. TERMINATION OF MEMBERSHIP: MEMBERSHIP will be terminated for the following reasons:

  • By decision of a competent judicial authority.
  • Due to the expiration of the term of duration.

ARTICLE XXI. DISCLAIMER OF LIABILITY: THE COMPANY is not responsible for money given to sales advisors or deposited into bank accounts other than those stated in the contract or through the website https://www.onvacation.comm

 

ARTICLE XXII. INVALIDITY: The invalidity or nullity of any of the articles of these Regulations shall not affect in any way the validity, legality, and applicability of the other provisions of these Regulations. Failure to enforce any article contained in these Regulations does not constitute a waiver of such article or preclude its subsequent enforcement.

 

ARTICLE XXIII. APPLICABLE LEGISLATION: Everything provided for in this Regulation shall be governed by the laws of the Republic of Colombia, especially those corresponding to the regulation of timeshare, Law 1480 of 2011, Law 300 of 1996, and Decree 1074 of 2015 modified by Decree 254 of 2022.

 

ARTICLE XXIV. NOTIFICATIONS: All communications regarding modifications to these Regulations will be delivered personally, by certified mail, via email, or by open publication for consultation on the website of THE COMPANY, addressed to THE MEMBER, at the address registered in THE CONTRACT or the one designated in writing at a later date.

 

ARTICLE XXV. DISPUTE RESOLUTION: Any differences arising from the execution and interpretation of this CONTRACT shall be submitted to a direct settlement process. If the differences cannot be resolved through this process, the parties may resort to the ordinary courts.

 

ARTICLE XXVI. USE OF THE REGULATIONS AND UPDATES: When references or allusions are made to the Regulations of Use, or General Conditions, or simply the Regulations, it should be understood that the reference is made to this document, which will be updated periodically taking into account market dynamics, the operation of the hotels, the needs of the AFFILIATES and other applicable circumstances, therefore when the regulations are updated they will be sent for the information of the AFFILIATE through any of the contact means that they have registered and will also be kept updated on the company's website.
